This is a heartbreaking real-life story — the Pune Porsche case, a tragic accident that took the lives of two young engineers, Anish and Ashwini. They were killed by a speeding Porsche driven by Vedant Aggarwal, a teenager who is not legally allowed to drive and was under the influence of alcohol.
The Pune Porsche Case
On May 19, 2024, Vedant Agarwal, aged 17 years old, murdered two motorcycle riders in a car accident in Pune, Maharashtra, in the Kalyani Nagar area. Both of the deceased, Ashwini Koshta and Aneesh Awadhiya, lived in Madhya Pradesh. Vedant had purchased and consumed alcohol before the incident, and he was driving an unregistered Porsche Taycan, which is considered a luxury car.
Pune Porsche Incident
On May 18, 2024, around 10:30 p.m., Vedant Aggarwal celebrated his CBSE 12th Board Exam with a group of his friends in Koregaon Park’s Cosie Restaurant and Bar. After serving the party of youngsters beer till midnight, the restaurant asked them to leave and refused to offer them any more. The 17-year-old rich boy used his grandfather’s credit card to pay ₹48,000 for the group’s drinks before departing.
At 12:25 AM, the party moved on to the Marriott Suites’ Blak Club. They were able to place an order and receive alcohol once more. They paid a ₹20,000 charge and left at 1:22 AM.
After a while in the area, the drunk Vedant started driving his father’s unregistered Porsche Taycan Turbo S towards his home. He lost control of the vehicle, which was traveling at about 200 kilometers per hour (124 mph), at 2:30 AM near the Kalyani Nagar crossroads.
He collided with a motorcycle, killing Aneesh Awadhiya and Ashwini Koshta. The passenger rider, Ashwini, passed away immediately, while Aneesh later passed away in a hospital from his wounds. After removing Vedant from the vehicle, the witnesses handed him over to the police.
Under Which Section Was The Case Registered?
Soon after the accident, Aneesh and Ashwini’s bodies were taken to Sassoon Hospital’s mortuary. Based on a complaint from Aneesh and Ashwini’s friend Akib Mulla, a formal complaint was filed against the minor at the Yerwada police station at 8:26 a.m. on May 19.
Instead of Section 304 (culpable homicide not amounting to murder), the FIR was filed under Section 304A (death by negligence). The maximum penalty for 304A is two years in jail, but the maximum penalty for 304 is either life in prison or ten years in prison.
Juvenile Board Rejected The Pune Police’s Petition To Treat The Accused As An Adult
On Tuesday, July 15, the Pune City Police requested that the CCL (Child in Conflict with Law) in the horrifying Pune Porsche case be tried as an adult, but the Juvenile Justice Board denied the petition. The decision was made more than a month after the Porsche accident in Pune, Maharashtra. The board decided that the accused driver will now be tried as a minor.
Last year, the Pune police requested that the accused be tried as an adult, claiming that he had committed a “heinous” act that included attempts to tamper with the evidence in addition to the crushing of two people to death.
According to the defense lawyer, the Juvenile Justice Board denied the police’s request on Tuesday to treat the accused youth as an adult.
Hours after the May 19 collision last year, the accused minor was granted bail. Three days later, the kid was sent to an observation home in Pune city after his light bail conditions, which included requiring him to write a 300-word essay on traffic safety, working with traffic police for 15 days, and undergoing psychiatric counselling, caused a national uproar.
The Bombay High Court ordered the boy’s immediate release on June 25, 2024, stating that the Juvenile Justice Board’s decisions to send him to an observation home were unlawful and that the juvenile law needed to be completely enforced.
What Happened With The Evidence?
According to the accused, the family’s driver was operating the vehicle at the time of the accident. In an attempt to get the driver to accept blame for the crash, the accused’s grandfather was jailed on May 25 for wrongful confinement of the driver. Additionally, the accused’s father was suspected by the authorities of tampering with the evidence.
As Rs 3 lakh was paid to change blood samples, two senior doctors from the Sassoon Hospital, Dr. Ajay Taware and Srihari Halnor, were arrested on May 27.
What Did The Defence Say On This Incident?
The crimes fall under the “serious” category, which prevents a minor accused person from being considered an adult, because none of the allegations in this case called for such a level of punishment.
Additionally, Mr. Patil noted that the Juvenile Justice Act’s goal is reformative rather than punitive, and that the boy’s psychological evaluation revealed no indications of criminal tendencies.
According to him, forcing the accused into the adult criminal justice system runs the risk of permanently harming any chance of his rehabilitation.
What About Other People Involved In The Pune Porsche Case?
In connection with this case, the boy’s father, two middlemen, hospital staff employee Atul Ghatkamble, and doctors Ajay Taware and Shrihari Halnor are currently jailed in the Pune Porsche case.
The child stays with his family members. But what about young people like this? A boy who grew up in a rich family, a boy who gets everything he wants — a good education, a rich family, and even a Porsche car at the age of 17. That’s why I believe that Vedant should not be treated like a minor — he should be treated like an adult for his trial. But because of this one legal technicality, criminals like Vedant have evaded justice before.
